There are two kinds of crimes: ones where you must be sued by the victim of the crime, and ones where a public prosecutor can sue you. Copyright infringments belong to the first category. There is nothing new in that.

If the "victim" has gone bankrupt, it is highly unlikely that anyone will sue you for spreading old stuff. I and many other C= file archive maintainers count on that and keep the old documentation, firmware and similar stuff online. On ftp.funet.fi I don't keep any commercial C64
games, because that would draw too much attention to the site, and I also want to maintain a certain level of quality on the site.
