It may add some non-linearity, depending also on the characteristics of the TED output, although level 2, 3, and 6 seem to be fairly accurate and consistent, and only 5 differs by a relatively large amount. Of course, it would be possible to test the TED output directly, however, I suspect that it would still not match the documentation. As I mentioned earlier, the most useful information would be data from many different machines.
By the way, the values in the VICE source code seem to make the same assumption as the pepto.de C64 palette, by dividing the black-white range into 32 equal steps, and choosing levels only from those. Although the results seem to be surprisingly similar to what I measured, I do not know why this restriction would actually exist in the hardware, and of course it ignores the possibility for any non-linearity.
